Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and related services provided by Brocour LLC ("Brocour," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms.
1. Eligibility and accounts
You must be at least 18 years old and legally able to enter into a binding agreement to use the Services. You must provide accurate account information, keep your account secure, and promptly notify us if you suspect unauthorized access. You are responsible for activity conducted through your account.
2. The Services
Brocour provides software for property discovery, organization, communication, documents, collaboration, and related workflows. Features may change over time. Property information may come from users or third parties and may be incomplete, delayed, or inaccurate. You should independently verify important property, legal, financial, and transactional information.
3. Your content
You retain ownership of content you submit to the Services. You grant Brocour a limited, non-exclusive, worldwide license to host, store, reproduce, process, transmit, and display that content only as reasonably necessary to operate, protect, and improve the Services. You represent that you have the rights needed to submit the content and grant this license.
4. Acceptable use

Do not violate law, infringe another person’s rights, or use the Services for fraud, harassment, discrimination, or deceptive activity.

Do not submit malware, attempt unauthorized access, interfere with the Services, bypass security or usage limits, or test vulnerabilities without written permission.

Do not scrape, copy, resell, or commercially exploit the Services or third-party property data except as permitted by law and an applicable written agreement.

Do not submit information you are not authorized to use or disclose.
5. Subscriptions and payments
Paid features, prices, billing periods, taxes, trial terms, and renewal details are shown before purchase. Unless stated otherwise at checkout, subscriptions renew automatically until canceled. You authorize the applicable payment or app-store provider to charge the payment method associated with your purchase. You may cancel through the billing controls made available by the provider through which you subscribed. Except where required by law or stated at purchase, charges already paid are non-refundable.
6. Third-party services and information
The Services may use or link to third-party maps, listings, payment services, app stores, websites, and other products. Third parties control their own services, content, terms, and privacy practices. Brocour is not responsible for third-party services or for decisions you make based on third-party information.
7. Brocour intellectual property
Brocour and its licensors own the Services, including the software, design, branding, and content we provide. Subject to these Terms, Brocour grants you a limited, personal, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose. No other rights are granted.
8. Suspension and termination
You may stop using the Services at any time. We may restrict, suspend, or terminate access when reasonably necessary to protect the Services or others, comply with law, address nonpayment, or respond to a material breach of these Terms. Provisions that by their nature should survive termination will remain in effect.
9. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Brocour disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. Brocour does not guarantee that the Services will be uninterrupted, error-free, secure, or that property information will be accurate or current. Nothing in the Services is legal, financial, tax, or investment advice.
10. Limitation of liability
To the fullest extent permitted by law, Brocour and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities. Brocour’s total liability arising from the Services or these Terms will not exceed the greater of $100 or the amount you paid Brocour for the Services during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
11. Changes
We may update the Services or these Terms. If a change materially reduces your rights, we will provide notice as required by law. Continuing to use the Services after updated Terms take effect means you accept the updated Terms.
12. General terms
These Terms and any additional terms presented for a feature form the entire agreement between you and Brocour regarding the Services. If one provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; Brocour may transfer them in connection with a reorganization, financing, merger, or sale of its business. Applicable law governs these Terms.
